چکیده
فصل سوم قانون اساسی جمهوری اسلامی ایران به حقوق ملت اختصاص دارد. بررسی فصل سوم قانون اساسی از منظر جامعهشناسی سیاسی مورد توجه قرار نگرفته است. سؤال اساسی که در این مقاله مطرح و مورد بررسی قرار گرفته این استکه حقوق ملت در فصل سوم قانون اساسی چه حقوقی را با توجه به اسناد بینالمللی حقوق بشری شامل شده و مهمتر اینکه زمینههای سیاسی اجتماعی آنچه بوده است؟ مقاله حاضر توصیفی تحلیلی بوده و با استفاده از روشکتابخانهای بهبررسی موضوع مورد اشاره پرداخته است. یافتهها حاکی است آنچه در فصل سوم قانون اساسی جمهوری اسلامی ایران مطرحشده با اسناد حقوق بشری در این خصوص همخوانی دارد هر چند برخی از این حقوق با محدودیتهای مواجه است. قانونگذار در فصل سوم، آزادی افراد را تا آن حد که به حقوق و آزادی دیگران، نظم عمومی و مبانی اسلامی ضرر نرساند، مورد تأکید قرار داده است. از منظر جامعهشناسی سیاسی نیز باید ریشه های فصل سوم قانون اساسی را باید در تحولات آزادیخواهانه انقلاب مشروطه و آزادیخواهی در این دوره جستجو کرد. زیرا آنچه در فصل سوم قانون اساسی جمهوری اسلامی ایران آمده است در قانون اساسی مشروطه گنجاندهشده بود. البته باید به مطالبات مردم در زمینه آزادی در دوره پهلوی که در شعار استقلال آزادی جمهوری اسلامی متجلی شده بود باید اشاره کرد. اندیشههای آزادیخواهانه اسلام فقاهتی اندیشمندانی چون شهید بهشتی و شهید مطهری و اسلام لیبرال که دکتر بازرگان نماینده آن بودند در توجه به آزادیهای فردی و عمومی در فصل سوم قانون اساسی بسیار تأثیرگذار بود.

The third chapter of the Constitution of the Islamic Republic of Iran is devoted to the rights of the nation. The study of the third chapter of the constitution has not been considered from the point of view of political sociology. The basic question raised and analyzed in this article is what rights of the nation are included in the third chapter of the constitution according to the international human rights documents and more importantly, what are the political and social contexts. Is? The present article is descriptive and analytical and has investigated the mentioned topic using a library method. The findings indicate that what is proposed in the third chapter of the Constitution of the Islamic Republic of Iran is consistent with the human rights documents in this regard, although some of these rights face limitations. In the third chapter, the legislator has emphasized the freedom of individuals to the extent that it does not harm the rights and freedom of others, public order and Islamic principles. From the point of view of political sociology, the roots of the third chapter of the constitution should be sought in the libertarian developments of the constitutional revolution and libertarianism in this period. Because what is mentioned in the third chapter of the Constitution of the Islamic Republic of Iran was included in the Constitution. Of course, it is necessary to mention the people's demands for freedom during the Pahlavi period, which was manifested in the slogan of independence and freedom.
